DescriptionTo be buried in one of the parishes churches of Mydhurst or Battell; funeral not to exceed 1000 marks
Executors to erect a seemly tombo with three great images of himself and his two wyves and all their armes placed about it. 100 marks to be distributed in the day of burial
Bequest to wife Lady Magdalen of all jewels which she had usually worn, also 1400 oz. of plate and silver vessels; also one bed of Tissue or Testere, with paines of crimson staten, with a quilt of crimson silke made for the same, with all other stuff, .... household furniture etc. at testator's house at Battell, as in the Inventory thereof (except the pictures mentioned in the said inventory and the hangings used in the Great Chamber at the Galery end and in the two chambers next adjoining to the Great Chamber And also except the brewing vessels, tables, boords, wainscottes .... yrons, bedsteades and the hangings of the historie of Alexander usuallie hanging in the Great Chamber at Battell). Wife to have the use of the excepted premises for life and after her decease, they to remain to Anthony Browne, testator's grandchild, son of late son Anthony, and to continue as heirloomes in the said mansionhouse at Battell
Also to wife, Lady Magdalen, £100 in ready money Also fowrtie (hole) (?) milche kine and one bull. Also all her apparel not contained in Inventory and her coche and coche horses and also 8 geldyngs with their furniture, two for herself and three for her women and three for her servants
To sister Marye, late wife of John Graye, sister Mabell, Countess of Kyldare, and sister Lucie Roper, a piece of silver plate guilt to the value of £10, each
To daughters, the Countess of Southampton, Elizabeth Dormer, and Jane Lacon, to each a piece of plate of the like value
To `my lytle sweete Jewell and neece Mall' Dormer £100 at marriage or 20 years
To every one of servants a year's wages
Provision for maintenance of hospitality for 3 months at the house where testator should happen to die
Bequest to said grandchild Anthony Browne of testator's `choller of golde of the order and all Georges, chaines, garters and roabes of the order of estate and Parliament' and the residue of the horsebeastes with their furniture, together with all caparisons and furnitures for horses and horsemen as well for tryumphes as for service, and the lease of the Netherlands and all stock of corn and grain and cattell and the residue of household stuff etc. and the library with all books, pictures etc. to be delivered to said grandchild Anthony Browne at 21 yrs. With provision in case of his death under 21
Residue of personal estate including `leases concerning `anye my yron workes' etc. to executors for performance of the Will
To every of the daughters of son Anthony at 20 yrs. or marriage, £1000. Grandchild to increase portions if convenient
The manors of Pearching, Poynings, Pingdeane als Pigdeane, and Preston Poynings, co. Sussex, which testator held in fee tail and the manor of Clayton, Sussex which he held in fee simple and the manor of Stockwell co. Surrey, to descend to next heir to the end the Queen should of the same manors etc. so left to descend for that purpose have and take such wardship, livery etc. as to her should by right belong
Revocation of uses declared by divers deeds etc., one of 20 Jan., 34 Eliz., specially mentioned, concerning various manors and new Appointment of uses as follows
The manors of Cocking, Lynche, Calceto, Rustington, Worthing Westbrooke juxta Borne, and Pytfolde to descend to next heir to the intent the same might supply one full third part of the manors etc. whereof the Queen should be entitled by way of wardship, livery or premier seisin
To wife Ladt Magdalen Mountague, in augmentation of her jointure, for life, the mansion house of S. Mary Overyes with all the stables, wharfs, gardens etc. belonging, with the use of the household stuff (excepting for the use of grandchild Anthony Browne the long stable with lofts over, the great vault forthright against the porter's lodge, with the way through the wharf to the water bridge. And excepting also the Jewell howse otherwise called the Evidence howse used for keeping of testator's evidences All which rooms, buildings etc., saving the said Jewell house being appointed to the said Anthony Browne on his attaining 21 years. The Jewell house and the keeping of the evidences being given and appointed to the Executors until said Anthony Browne should attain 21
Bequest to William Browne another of the sons of the said Anthonye, and to the heirs male of his body and Annuity of £25 issuing out of the site and demesne lands of the Abbey of Waverley, with power of distress
To John Browne, 2nd. son of the said son Anthony, and to the heirs male of his body the site and demesne lands of the Abbey of Waverley, with provision against alienation or any act affecting the estate tail or remainders etc., other than jointure for wife
To said William Browne, 3rd son of said son Anthony, and the heirs male of his body the manor of Pyrbright, with similar restriction of alienation etc
Devise and appointment of the manors of Cowdrey and Mydhurst Cowdrey Park or Single Park and the two North Parks and the parsonage of Easborne als Eastborne and the dissolved Priory of Easborne and the farms, messuages, lands etc. called Todham als Tadham, Aldersham als Balls ferme, and Culverlands And all other messuages, lands etc. in Mydhurst, Easborne, Farnehurst or Wollavington, and the reversion of the site of the priory of St. Mary Overies and the long stable and lofts etc. and the Jewell house or Evydence house at St. Mary Overyes and the reversions of the Abbey of Waverley and the manors of Pyrbright and all other manors, messuages, lands etc. mentioned in said deed (20 Jan., 34 Eliz) and not otherwise devised, and also the manor of Stedham and all issues and profits of the premises not exceeding £5000 And the manors of Cocking, Lynch, Calceto, Rustington, Worthing, Westbrooke juxta Borne, and Pytfolde and the manors of Claiton and Stockwell All to remain to the Executors until the Will had been performed
Devise that after the Will performed, all the said manors lands etc. (except Cocking, Clayton, Stedham, Westbrooke, Calceto, Rustington, Worthing, Pytfolde and Stockwell) should remain to the said Anthony Browne the grandchild, and the heirs male of his body, with contingent remainders successively in tale male to John Browne, brother of said Anthony, William Browne, brother of said Anthony, George Browne, testator's son. Henry Browne, testator's son, and William Browne, testator's brother and Henry Browne senr and Francis Browne, testator's brothers; ultimate reversion to the right heirs of the said Anthony Browne the grandchild
The manors of Cocking and others (above excepted) to descend to said Anthony Browne the grandchild and his heirs for ever
Annuities given by testator's father to testator's brothers, William, Henry, Framcis and Henry the younger, to be levied of the said manors of Cowdrey, Esborne, Mydhurst and the priory of Esborne, with power of distress
For the preferment of the issues female of said son Henry Browne, devise yhat if said Henry should die without issue male of his body, having issue female, that the lands, tenements etc. in Wytley and Pepperharowe, Surrey should remain to such issue female until 1000 marks be paid to them by the presumptive heir
If any of the entailed premises should come to any one of testator's brothers, he to pay to testator's daughters and children of deceased daughters £4000
Executors to have both keys of the Jewell house or Evidence house for keeping Letters Patent, charters, deeds etc. until said Anthony the grandchild or the next heir male of his body should attain 21 and then the keys and evidences to be delivered to him
Executors: wife the Lady Magdalen Mountague, Sir Robert Dormer, knt., Edward Gage, Richard Lewknor and Edmund Pelham, esqs., and Francis Rydell and Thomas Churchar, testator's servants, and gift to each as a remembrance and not any recompence of their pains, travell and charges, 40 marks
Overseer: the Rt. Hon. Sir Thomas Hennage, knt., P.C., Chancellor of the Duchy, with legacy of £100
Witnesses:- Anthonye Mountague, George Browne, Fran. Lacon, Rychard Cotton, John Cotton, Roger Abdye, Robert Gray, W. Spencer, William Stephenson.
